The 9th Annual GENNEXT Business & Law Congress, 2020, to be held on March 6th and 7th, 2020, at HOTEL TAJ LANDS END, MUMBAI, INDIA, will see thought leaders and policymakers congregate to discuss the impact of geopolitics on business and how organizations can tide over threats while cashing in on opportunities.

The past few years have brought a wave of reforms for India; demonetization, the Goods and Services tax (GST) and the Fugitive Economic Offenders’ bill, not to mention the lending of more teeth to the Prevention of Money Laundering Act, Companies Act and the Insolvency and Bankruptcy Code. Barely days ago, the Judiciary brought a contentious socio-political issue to its logical conclusion by ordering that the disputed land in AYODHYA be handed over to the RAMJANMABHOOMI trust for building a Ram temple and an alternate five acres of land be handed over to the SUNNI WAQF BOARD for building a mosque. However, as India pushes on all fronts to occupy pride of place in the world, it cannot afford to ignore the key geopolitical undercurrents driving business and governance across the globe.

For starters, we are moving from a US-dominated to a multipolar world partly due to the growth in emerging economies and partly due to inequality and political discontent in developed markets. This will result in intensely higher levels of complexity for businesses spanning the globe. Secondly, Western democratic models are being challenged by alternative political systems that have proved more resilient and less fractious while tackling global challenges. Thirdly, the 4th Industrial Revolution is well upon us, and its formidable combination of big data, analytics and technology promises to disrupt not only global business but also our world order. These major shifts are manifesting themselves in developments such as the corroding relations between USA and China, internal and external challenges to the unity and stability of the European Union (EU), and a move towards evolution and not revolution in global trade relations, among others.

Saugata Chakravarty heads the team of around 36people at Siemens Ltd, a public listed company in India [having a consolidated annual turnover of INR ~12,700 crores, net worth of INR~6,900 croresand employing 9,580 employees (Sep 2018)].He is currently serving on the Board of Directors ofSiemens group entities such asPowerplant Performance Improvement Limited and German Business community and Consulate General Earthquake Assistance Foundation. Earlier he was the Director of Siemens Postal and Parcel Logistics Technologies Private Limited, Siemens Postal Parcel and Airport Logistics Private Limited, E-meter India Private Limited, Siemens Convergence Creators Private Limited and Siemens VAI Metals Technologies Private Limited. Saugata is part of the Executive Management team of Siemens Limited. He is also a permanent invitee to the Board meetings and Management Committee meetings of Siemens Limited. Additionally, Saugata also has the very important responsibility of overseeing the Legal activities of Sri Lanka and Bangladesh.

His team comprises of legal counsels, contract managers (many such contract managers have non-legal, but project background) and Company Secretaries. In addition to the overall responsibility of Legal, Compliance Regulatory & Ethics concerning primarily corporate ethics, white collar & financial violations, anti-trust, data privacy, anti bribery and our business partners’ compliance thereby safeguarding the name of Siemens is of paramount importance to his duties.

Saugata strives for Legal to develop innovative business solutions within the boundaries of law to enable business, supports the business in managing contractual terms of Siemens to ensue an appropriate balance between risk mitigation and market conditions. An important task is also to provide legal claim management to reduce non-conformance costs and pursue claim recoveries.

Finally, Saugata’s most cherished duty is to enhance the role of Legal as a trusted business partner to ensure proximity and deliver value add and foster corporate memory with best practice sharing and a lessons learned program. He also sees that Legal develops a competent strategy and proactive measures to protect the company’s interests, support merger and acquisition related transactions and ensures that the company conducts its business as per its stated ideals and in a fully-compliant manner.

Saugata’s very able leadership of the Legal Department at Siemens India has not gone unnoticed. In fact the Siemens India Legal Department has been the winner of the prestigious IDEX Award for Best In-house Legal Dept. for three years in a row (2013 – 2015). In 2016 Saugata was chosen as the General Counsel of the year by IDEX. He is also named in the top 100 of GC Power List – India of 2016 -17 at Legal 500.
