Resolutions Professional and a Liquidator
Prakash has over two decades of impeccable experience, in a variety of roles - as a Practising Company Secretary, Advisor on Corporate Laws, appearing before Tribunals; Secretarial Auditor; earlier served as an Independent Director of a large Conglomerate; Insolvency Professional and elected as Chairman of Western Region of the Institute of Company Secretaries of India (ICSI) for 2017.
Prakash was a partner of BNP & Associates, a prominent firm of Company Secretaries in Secretarial Audit. He was handling highest number of Secretarial Audit of Nifty fifty companies and of National Stock Exchange of India Ltd.
Prakash’s forte lies in corporate law advisory, litigation - appearance before NCLT, SEBI and SAT and restructuring (merger, demerger and amalgamation). Prakash has passion to act as an insolvency resolution professional and as liquidator. He is having a first-hand experience in handling IBC cases at NCLT level and acting as resolution professional, he has the overview of the rapidly evolving Indian insolvency regime.
Prakash is currently acting as Resolution Professional in 2 (two) ongoing insolvency proceedings (one of which is a big-ticket) and other of a developer company. While one corporate debtor is under liquidation, in another, resolution plan is before NCLT. In one of the IP cases, he has been successful to bring to the notice of Committee of Creditors a ring fencing transactions of Rs.116.80 crore and got order of NCLT in favour. He also acts as liquidator in voluntary winding-up of companies – as of now in two companies - that of a subsidiary of multi-national Bank and other of a multi-national business conglomerate under the IBC, 2016.
He has been involved in strategic advisory and representation in high profile securities cases of the Country before SEBI and NCLT. Above gives Prakash a ring side view of corporate and insolvency laws and he brings real-time experience in the corporate law litigation, insolvency proceedings and transaction advisory. He has trained officials of Ministry of Railways, Ministry of Corporate Affairs, Board of LIC, students of ICSI, Company Secretaries and Insolvency Professionals on Corporate Laws and IBC. He interacts and gives suggestions and inputs to SEBI, MCA and Insolvency and Bankruptcy Board of India on matters put for public comments. He is working closely with IBBI in some of the possible improvements of insolvency process. He has written several books including on Corporate Governance (Taxmann), Supreme Court on SEBI Act, etc. He prepared research material on NCLT for ICSI which was submitted by ICSI to Minister of MCA. Prakash is avid reader not only of legal books but also of bio-graphies and motivational literature.
